1. Agreement to Terms

By accessing or using the services provided by SHC Stoneham Concrete, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of our services after changes are posted constitutes acceptance of those changes.

2. Services Provided

SHC Stoneham Concrete provides concrete installation, repair, and maintenance services for residential and commercial properties. All services are subject to availability, proper site conditions, and weather requirements. We reserve the right to refuse service for projects that do not meet safety standards or building code requirements. Project timelines and completion dates are estimates and may be affected by weather, material availability, or unforeseen site conditions.

3. Estimates and Pricing

All project estimates are provided free of charge and are valid for 30 days from the date issued. Estimates are based on information available during the initial site visit and may change if conditions differ from what was observed or disclosed. Final pricing is determined by the scope of work, materials used, and actual site conditions encountered during the project. Additional charges may apply for work beyond the original scope or for changes requested by the client after work has begun.

4. Payment Terms

Payment terms are outlined in your project contract or estimate. We typically require a deposit before starting work, with the balance due upon completion. Payment can be made by cash, check, or credit card. Late payments may be subject to additional fees as outlined in your contract. If payment is not received within the agreed timeframe, we reserve the right to place a lien on the property for the amount owed.

5. Project Timeline and Delays

We make every effort to complete projects on schedule. However, concrete work is weather-dependent and may be delayed by rain, extreme temperatures, or other environmental factors beyond our control. We will notify you of any significant delays and provide updated timelines as soon as possible. Delays caused by weather, material shortages, or issues discovered during site preparation do not constitute a breach of contract.

6. Client Responsibilities

You are responsible for providing accurate information about your property, including utility locations, property lines, and any existing conditions that may affect the project. You must obtain any necessary permits or approvals required by your municipality before work begins. You agree to provide clear access to the work area and to keep pets, children, and unauthorized persons away from the construction site for safety reasons. Failure to meet these responsibilities may result in project delays or additional costs.

7. Warranty and Guarantees

We stand behind the quality of our work and materials. Specific warranty terms are provided in your project contract and vary based on the type of work performed. Our warranty covers defects in workmanship and materials under normal use and conditions. The warranty does not cover damage caused by improper use, neglect, extreme weather events, ground settling beyond normal parameters, or modifications made by others. Any warranty claims must be submitted in writing within the specified warranty period.

8. Limitation of Liability

Our liability is limited to the amount paid for the services provided. We are not responsible for indirect, incidental, or consequential damages arising from our services. We carry appropriate insurance coverage for our business operations. Claims for property damage or injuries must be reported immediately and will be handled according to our insurance policies and applicable law.

9. Cancellation Policy

If you need to cancel or reschedule your project, please notify us as soon as possible. Cancellations made before work begins may be subject to a cancellation fee to cover administrative costs and reserved scheduling. Once work has started, you will be responsible for payment for all work completed and materials purchased. If we need to cancel due to circumstances beyond our control, we will provide a full refund of any deposits paid.

10. Dispute Resolution

If any dispute arises regarding our services, we encourage you to contact us directly to resolve the matter. Most concerns can be addressed through open communication. If a resolution cannot be reached through direct discussion, disputes will be handled according to Massachusetts law. Both parties agree to attempt mediation before pursuing legal action.
